Following the refusal of planning permission for a proposed single wind turbine, Orion Heritage was appointed as the heritage witness for the appeal. One of Orion's directors was involved in the scheme prior to the refusal of permission while in a previous employment. The proposed wind turbine was refused on the basis of the supposed effects on the setting and significance of a number of designated heritage assets, including Baconsthorpe Castle which is a scheduled monument and grade I listed structure, as well as on landscape grounds. The appeal was conjoined with another single wind turbine that was refused on similar grounds, as it affected some of the same assets. Orion Heritage provided the heritage expert witness at the Public Inquiry. 

The appeal was upheld as the Inspector agreed with Orion Heritage that the effects of the turbine amounted to less than substantial harm and that the public benefits outweighed this harm. The appeal was subsequently the subject of a High Court challenge on cumulative grounds and so has not been progressed.
