Orion Heritage provided the heritage expert witness for an appeal for a proposed housing scheme. Following the refusal of planning permission, Orion Heritage was appointed to negotiate with the LPA and its built heritage consultants regarding the heritage issues of the appeal. Following a detailed analysis of setting of a number of grade II* and grade II listed buildings, a scheduled monument and a conservation area, Orion Heritage were able to reach agreement with the LPA's consultant that the impact on the significance of the nearby designated heritage assets was low on the less than substantial range, and that para 134 of the NPPF was the appropriate planning test to satisfy. Orion Heritage devised and agreed the heritage Statement of Common Ground with the LPA and thereby avoided heritage being a contentious issues at the Public Inquiry.  

The Planning Inspector agreed with Orion's assessment of the effect of the proposed scheme and found that, while still mindfull of S66 of the 1990 Planning Act, the benefits of the scheme outweighed the limited harm to the designated assets.  The Inspector upheld the appeal.
